General

This Agreement, sets forth the terms and conditions that apply to use of this site (http://lapolo.in/) and all sub sites that reside under the site (collectively, "LA POLO International Pvt. Ltd. Sites"), by a Subscriber. "Subscriber" means each person who establishes or accesses a connection ("Account") for access to and use of the LA POLO International Pvt. Ltd. Sites.

Restrictions on use

The LA POLO International Pvt. Ltd. Sites are owned and operated by LA POLO International Pvt. Ltd. ("the Company"),an LA POLO International Pvt. Ltd. group company, and contains material which is derived in whole or in part from material supplied by the Company, its group companies, various news agencies and other sources (including content partners), and is protected by international copyright and trademark laws. The restrictions on use of the material and content on the LA POLO International Pvt. Ltd. Sites by the Subscriber are specified below. Except where specifically authorised, the Subscriber may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from the LA POLO International Pvt. Ltd. Sites including code and software.
By using the LA POLO International Pvt. Ltd. Sites (other than to read this Agreement for the first time), Subscriber agrees to comply with all of the terms and conditions hereof. The right to use the LA POLO International Pvt. Ltd. Sites is personal to Subscriber and is not transferable to any other person or entity. Subscriber is responsible for all use of Subscriber's Account (under any screen name or password) and for ensuring that all use of Subscriber's Account complies fully with the provisions of this Agreement. Subscriber shall be responsible for protecting the confidentiality of Subscriber's password(s), if any.
The Company shall have the right at any time to change or discontinue any aspect or feature of LA POLO International Pvt. Ltd. Sites, including, but not limited to, content, hours of availability and equipment needed for access or use.

Changed Terms

The Company shall have the right at any time to change or modify the terms and conditions applicable to Subscriber's use of the LA POLO International Pvt. Ltd. Sites, or any part thereof, or to impose new conditions, including but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including but not limited to, posting on the LA POLO International Pvt. Ltd. Site, or by electronic or conventional mail, or by any other means by which Subscriber obtains notice thereof. Any use of the LA POLO International Pvt. Ltd. Site by Subscriber after such notice shall be deemed to constitute acceptance by Subscriber of such changes, modifications or additions.

Equipment

Subscriber shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the LA POLO International Pvt. Ltd. Sites and all charges related thereto.

Subscriber Conduct

Subscriber shall use the LA POLO International Pvt. Ltd. Sites for lawful purposes only. Subscriber shall not post or transmit through the LA POLO International Pvt. Ltd. Sites any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give right to civil liability or otherwise violate any law, or which, without the Company's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a Subscriber that in the Company's discretion restricts or inhibits any other Subscriber from using or enjoying LA POLO International Pvt. Ltd. Sites will not be permitted. Subscriber shall not use LA POLO International Pvt. Ltd. Sites to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with the LA POLO International Pvt. Ltd. Sites. LA POLO International Pvt. Ltd. Sites contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music or sound, and the entire contents of LA POLO International Pvt. Ltd. Sites are copyrighted as a collective or severable work under applicable copyright laws. The Company and/or its affiliates own or have acquired a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. Subscriber may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Subscriber may download copyrighted material for Subscriber's personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of the Company and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. Subscriber acknowledges that it does not acquire any ownership rights by downloading copyrighted material.
Subscriber shall not upload, post or otherwise make available on the LA POLO International Pvt. Ltd. Sites any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with Subscriber. Subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of LA POLO International Pvt. Ltd. Sites, Subscriber automatically grants, or warrants that the owner of such material has expressly granted the Company the royalty fee, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. Subscriber also permits any other Subscriber to access, view, store or reproduce the material for that Subscriber's personal use. Subscriber hereby grants the Company the right to edit, copy, publish and distribute any material made available on LA POLO International Pvt. Ltd. Sites by Subscriber.
The foregoing provisions are for the benefit of the Company, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

Disclaimer of Warranty: Limitation of Liability

Subscriber expressly agrees that use of LA POLO International Pvt. Ltd. Sites are at Subscriber's sole risk. Neither the Company, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that LA POLO International Pvt. Ltd. Sites will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of LA POLO International Pvt. Ltd. Sites, or as to the accuracy, reliability or content of any information, service, or merchandise provided through LA POLO International Pvt. Ltd. Sites.
LA POLO International Pvt. Ltd. Sites is provided on an "As Is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.
This disclaimer of liability applies to any damages or injury, caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Subscriber specifically acknowledges that the Company is not liable for the defamatory, offensive or illegal conduct of other subscribers or third-parties in cases including but not limited to any interactive communication on or through the sites and that the risk of injury from the foregoing rests entirely with subscriber(s).
In no event will the Company, or any person or entity involved in creating, producing or distributing LA POLO International Pvt. Ltd. Sites or the LA POLO International Pvt. Ltd. Sites software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use LA POLO International Pvt. Ltd. Sites. Subscriber hereby acknowledges that the provisions of this section shall apply to all content on LA POLO International Pvt. Ltd. Sites.
In addition to the terms set forth above neither, the Company, not its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within LA POLO International Pvt. Ltd. Sites, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Prior to the execution of a stock trade, subscribers are advised to consult with your broker or other financial representative to verify pricing or other information. The Company, its affiliates, information providers or content partners shall have no liability for investment decisions based on the information provided. Neither, the Company, nor its affiliates, information providers or content partners warrant or guarantee the timeliness, sequence, accuracy or completeness of this information.

Acceptance

These LA POLO International Pvt. Ltd. Service Terms together with the Privacy Policy and all other additional terms and information that may be provided within the Service (collectively “Terms”) govern your use of the service, site, content and software (collectively the "Service"). By registering for or using the Service or any portion of it you accept the Terms.
The Terms constitute an agreement between you and LA POLO International Pvt. Ltd. including its affiliates and suppliers (collectively “LA POLO International Pvt. Ltd.”), defining your and LA POLO International Pvt. Ltd.’s rights and responsibilities with respect to the Service.

Licenses

LA POLO International Pvt. Ltd. grants you a non-exclusive, non-transferable license, revocable at any time at LA POLO International Pvt. Ltd.’s sole discretion, to access and use the Service strictly in accordance with the Terms. Use of the Service does not grant you any intellectual property rights in or to any information or content in the Service.
As part of the Service, LA POLO International Pvt. Ltd. may provide you with content developed by LA POLO International Pvt. Ltd. or its licensors (“Content”). LA POLO International Pvt. Ltd. grants you a non-exclusive and perpetual license to use Content for the purpose it is intended, unless otherwise defined in the applicable Terms or the purchase order. You are bound by any restrictions applicable to specific Content you obtain through the Service. Any license acquired to third-party Content is a binding agreement between you and the third-party Content provider. You have only the rights to the Content which are expressly granted here.
As part of the Service, LA POLO International Pvt. Ltd. may provide you with certain software developed by LA POLO International Pvt. Ltd. or, its licensors (“Software”). Your use of Software may be subject to separate terms and conditions that you must accept before using the Software. If there are no separate terms and conditions applicable to such Software, the following terms apply: LA POLO International Pvt. Ltd. grants to you a limited, non-exclusive, non-transferable right to install and use the Software on your computer and/or mobile device. You may not copy the Software, except to make a single archival backup copy. You may not distribute, transfer the right to use, modify, translate, reproduce, resell, sublicense, rent, lease, reverse engineer, or otherwise attempt to discover the source code of or make derivative works of the Software. For open source licensed software, applicable open source license terms apply.
You may be able to submit information or content (“Material”) to the Service. LA POLO International Pvt. Ltd. does not claim ownership in your Material. Your submission of Material does not transfer ownership of rights of the Material to LA POLO International Pvt. Ltd.. LA POLO International Pvt. Ltd. is only transmitting the Material and is not responsible for editorial control over it. By submitting Material to the Service you grant LA POLO International Pvt. Ltd. a world-wide, non-exclusive, sub-licensable, assignable, fully paid-up, royalty-free, perpetual and irrevocable license to use, copy, publicly perform, display, distribute in any media and modify the Material to incorporate the Material into other works, and to grant similar sublicenses to the extent necessary for LA POLO International Pvt. Ltd. to provide the Service. You may be able to adjust this grant in the privacy and other settings of the Service.
You are solely responsible for taking backup copies of the data you store on the Service, including Content you upload. If the Service is discontinued or canceled, LA POLO International Pvt. Ltd. may permanently delete your data. LA POLO International Pvt. Ltd. has no obligation to return data to you after the Service is discontinued or canceled.

Using the Service

You agree to:

Comply with applicable laws, the Terms and good manners;
Use the Service only for your personal, non-commercial purposes;
Not submit unlawful, offensive, inaccurate, misleading, abusive, pornographic, harassing, libelous, blasphemous, defamatory, obscene, pedophilic, invasive of another’s privacy, hateful, racially or ethically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise inappropriate material.
Not to upload or share any information that impersonates another person, threatens the unity, integrity, defence, security or sovereignty of India.
Obtain any consents, permission or licenses that may be legally required for you to submit any Material;
Respect the privacy of others;
Not distribute or post spam, unreasonably large files, chain letters, pyramid schemes, viruses; or
Not use any other technologies or initiate other activities that may harm the Service, or the interest or property of the Service users.
Not to use any automated systems or means to access, acquire, copy or monitor any part of the service.
Be responsible for the consequences related to the Material that you post.

Monitor or moderate any Content or Material;
Remove any Material from the Service; and
Restrict access to any part of the Service at any time in its sole discretion.

Content

Before downloading or accessing any Content, please check whether the Content which you wish to access is restricted by age or marked as potentially ‘offensive’ or ‘explicit’. LA POLO International Pvt. Ltd. shall not be responsible for any claims or offense caused or suffered by you accessing such Content. You agree:

Notices

LA POLO International Pvt. Ltd. may post notices within the Service. LA POLO International Pvt. Ltd. may also send you notices about products and Services to the email address or telephone number you have provided to us. You are deemed to have received such notices at the latest within seven (7) days from LA POLO International Pvt. Ltd. sending or posting those. Your continued use of the Services constitutes your receipt of all notices regardless of delivery method.

Fees

Your use of the Service may be or may become subject to charges. Use of the Service may involve transmission of data through your service provider’s network. Prices listed within the Service do not include possible data transmission, text message, voice or other service provision charges by your network service provider.
LA POLO International Pvt. Ltd. assumes no responsibility for the payment of any charges of your service providers.

Order and Payment Terms

"Order" shall mean the selection of payable Content and/or subscription to Content offered by LA POLO International Pvt. Ltd. and available in the Service and submission of payment method, as well as submitting the order by selecting the "buy", "ok", "I accept" or other similar confirmation of acceptance in the order flow or providing other indication of acceptance terms that are presented to you in the order flow.
You agree that all Orders shall be legally valid and binding. All Orders are subject to acceptance by LA POLO International Pvt. Ltd..
You may pay by credit or debit card, network service provider billing, or other payment methods if available.
Your credit or debit card must have a billing address in the country where the Content is offered by the Service. LA POLO International Pvt. Ltd. will charge your credit card or debit your bank account within a reasonable time after you have made your Order. All credit card payments are subject to validation checks and authorization by the card issuer.
If you choose network service provider billing, charges will appear on your mobile phone bill or be deducted from your prepaid account if it is a prepaid account. Some network service providers may subject your usage of the Service to additional terms and conditions including placing limits on the amount of charges possible with network service provider billing. Charges in excess of network service provider limits or account balance may be rejected
You agree to pay the charges related to your Order, to ensure that the instrument of payment is valid at the time of the Order, that you are the rightful holder of the instrument and that the instrument is used within its credit limits.
The Content that is delivered is licensed to you. You agree to use such Content solely as permitted in these Terms and in any additional terms that you may be presented in the order flow.
The Service may offer subscriptions. You authorize the Service to place a periodical charge during the period of the subscription. The Service may also offer a trial period. If your Order involves a trial period (also known as try-and-buy), you may be charged when the trial period expires, unless you cancel in accordance with the subscription/trial terms.

Indemnification

You agree to defend and indemnify LA POLO International Pvt. Choice of Law

The Terms are governed by the laws of India. The Courts at New Delhi shall have exclusive jurisdiction over any dispute arising out of your use of the Service.

Additionally, LA POLO International Pvt.
